Terms and conditions

Definitions

  • Me/I: Michael Weavers trading as Peak Editorial.

  • You: the natural or legal person commissioning the job.

  • Job: the piece of work commissioned by you.

  • Service: the treatment you require for your text.

  • In writing; includes communication in hard copy, by email, SMS, WhatsApp and other similar media.


Agreement of terms

Before starting a job, you and I will agree in writing:

  • The service to be delivered.

  • The date or dates for the delivery of the job.

  • The format in which you will provide the job, i.e. hard copy or electronic (and if electronic, the file format), and the format in which I will return the completed job.

  • An estimate of the time required to complete the job.

  • The date by which the competed job will be delivered to you.

  • The fee chargeable.

  • Any expenses and who is responsible for meeting these.

  • The contact details of the person or department to whom my invoice should be sent.


Timetable

  • In exceptional circumstances, the timetable for delivery of a completed job may be extended. I will contact you as soon as I believe this may be the case and we shall attempt to agree a revised timetable.  If this is not possible, I will return the job to you. I may invoice for the work completed to that point.


Fees

  • Fees, once agreed, are non-negotiable.

  • If a job is unusually large or likely to be delivered over an extended period, we may agree payment by instalments across the lifetime of the project.


Payment

  • Invoices will be sent on completion of the job (or agreed part of the job).

  • Invoices are payable within 30 days of issue.

  • I am not VAT registered and do not charge VAT.

  • Payment can be made by BACS or cheque (drawn on a Sterling account).

  •  All payments are to be made in Sterling. You are responsible for any fees or charges relating to currency transfers or exchanges.

  • I reserve the right to claim statutory interest at eight percentage points above the Bank of England base rate from the date the invoice becomes due, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 (‘the Act’) and the Late Payment of Commercial Debts (Rate of Interest) (No. 3) Order 2002. I reserve the right to claim an additional sum for pursuing the debt as provided for in the Late Payment of Commercial Debts Regulations 2002.


Acceptance and complaints

  • I will do my best to make your job free from errors. You will accept that this cannot be guaranteed, and that proofreading, copy editing and other services are subjective, and there will sometimes be differences of opinion.

  • You will confirm in writing that you are happy with the completed job within seven days of receipt. Failure to do so indicates satisfaction.

  • Any complaint must be raised in writing within seven days of receipt of the completed job. I will investigate your complaint within 14 days.

  • I am an entry-level member of the Chartered Institute of Editing and Proofreading (CIEP) and adhere to its code of practice. The CIEP has a complaints procedure.


Unforeseen circumstances

  • If I am affected by unforeseen circumstances (e.g. illness or bereavement) I will endeavour to contact you as soon as possible. We may agree a revised timetable or cancellation of the job.

  • If you or I are victims of extraordinary events beyond our control (e.g. crime, fire, flood), liability and obligation may be cancelled.


Data protection

  • I collect personal data as part of my business. This consists of your name, telephone number(s), email address(es) and postal address(es).

  • I will not share your personal data with third parties, except when required by law.

  • You may request the deletion of your personal data. I will do this without undue delay, unless retention is required by law.

  • I will delete your personal data three years after our last job, unless required by law to retain it for longer.

  • Your personal data and other information are held on a password-protected computer and may be stored in cloud-based systems. Hard copy data are held securely in my office.


Commercial confidentiality

  • I will not share any commercially confidential information with third parties, unless required by law.


Acknowledgements

  • You are not required to mention me in any acknowledgements. If you wish to do so, you will ask my permission before publication.


Revisions

  • Any revision to my terms and conditions will be shown on this page. The current version was published on 25th July 2022.
